Terms & Conditions - Sydney Flower Walls

These Terms & Conditions (“Terms”) govern all hire agreements between [Your Business Name] (“the Owner”, “we”, “us”) and the hirer (“the Client”, “you”). By booking and paying for a hire, you agree to these Terms.

1. Booking & Payment

  • A booking is confirmed only when a deposit is received.
  • The remaining balance is due no later than 7 days before the event date.
  • All prices are inclusive of GST.

2. Hire Duration & Additional Fees

  • Standard hire duration is 12 hours.
  • If the Client requires a longer period, this must be arranged in advance and may incur additional fees.

3. Delivery & Collection

  • The Owner will deliver, set up, and collect the hire item(s) at the agreed location and time.
  • The Client must ensure clear access for safe delivery and collection.
  • Additional fees may apply if delivery/collection is delayed due to site access issues.

4. Care, Use & Responsibility of Hire Items

  • The flower wall remains the property of the Owner at all times.
  • The Client agrees to take reasonable care to prevent damage, theft, or misuse of the hire item(s).
  • Guests must not climb, lean heavily, or attach items (e.g., signage, balloons) to the flower wall unless agreed in advance.
  • No adhesives, tapes, paints, pins, or modifications may be made to the flower wall.
  • The Client must ensure the flower wall is not exposed to water, fire, smoke, or other potentially damaging substances.
  • Any damage, loss, theft, or excessive cleaning required will be the Client’s responsibility. Costs may be deducted from the security bond, and if the bond does not cover the full amount, the Client will be invoiced for the balance.

5. Security Bond & Damage Fees

  • A refundable security bond of $200 is required prior to delivery.
  • The bond will be refunded in full within 7 days after the event, provided the hire item(s) are returned in good condition.
  • If damage, loss, or excessive cleaning occurs, the cost of repair or replacement will be deducted from the bond.
  • If the cost of damage or replacement exceeds $200, the Client will be responsible for paying the difference.

6. Cancellations & Refunds

  • All cancellations and refund requests will be handled in line with our Refund & Cancellation Policy.
  • No refunds are available for change of mind.
  • If the flower wall does not reasonably match the description provided at the time of booking, the Client may request a partial refund or credit towards a future hire, depending on the extent of the difference.
  • Refund requests must be submitted in writing via email.
  • Refunds will be processed within 7 days.

7. Indemnity

The Client hereby releases the Owner from, and agrees to indemnify the Owner against, any third-party claims, actions, suits, demands, costs, or expenses for damage or injury to person or property arising directly or indirectly from the hire or use of the equipment by the Client.

8. Breach of Terms

  • If the Client breaches any of these Terms, the Owner reserves the right to:
    • Retain part or all of the security bond, and/or
    • Cancel the hire immediately and remove the hire item(s), without refund.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
